While the Illegal Migration Bill will clear the Commons on Wednesday night, peers are threatening to tear it apart in the House of Lords, not least because it plays fast and loose with international law.

The fact that the crackdown was not in the Tories’ 2019 manifesto also gives unelected peers a freer hand to make changes than on other policies., introduced more than a year ago, is still mired in a Court of Appeal case, with Supreme Court and Strasbourg hearings likely to follow before a final judgement is made on its legality.

The current Bill faces similar challenges, and is therefore unlikely to be operational by the next election. Even if the policy does get up and running, there are serious questions around capacity, workability and deterrence. These are among the many reasons Tory MPs fear Mr Sunak may ultimately be hoisted by his own petard when voters realise he has failed on his promise to “stop the boats”. And that could mean defeat in the Tories’ bid to make the culture war front central to British politics.
