Prison officer murder accused tells court of moment he killed friend celebrating 40th birthday
A prison officer accused of murdering his friend told jurors that he feared he was going to ‘possibly rape’ him so put him in a chokehold to ‘regain control’.
He said they ‘got on’, adding: “He was quite open about his sexuality as a gay man, he didn’t mention a partner. When asked by his barrister, Richard Littler KC, if it bothered him, he said: “No, because technically, it’s his work. It doesn’t bother me, it doesn’t affect me. It’s what he does. There was no reason to think anything different of him because of what he was doing.”
On the taxi journey back to the flat, he said there were discussions about drugs. He told jurors that he didn’t want to take any drugs because they ‘didn’t need any’. “I sat down next to Dave and he got a plate and moved it towards me gesturing and it looked like there were a couple of lines of white powder. He pushed it towards me, I hadn’t asked and stupidly I took some.
He said he tried shouting out to Ms Smith and Ms Burns, who were both asleep, as he ‘knew they needed medical attention’. Mr Toulson then came into the bathroom, before ‘lifting’ Mr Johnson’s head off the floor and using his fingers to stimulate ‘oral sex’, the defendant said.“He then dropped my head and grabbed my ankle and started pulling me out of the bathroom and towards the bedroom.
