Detectives have launched a re-investigation into the alleged murder of Ryan Passey, five years after a teenager who admitted stabbing him was found not guilty of both murder and manslaughter, having claimed it was an accident robhastings reports:
He told his trial at Birmingham Crown Court in 2018 that he was holding the flick knife when it entered Mr Passey’s body and that he “felt bone”.
The judge explained to the jury during the trial that to find someone guilty of murder, they must be sure that the defendant “did not act in lawful self-defence” and “intended to cause really serious harm” to their victim. For a manslaughter conviction, they needed to be “sure that he intended to cause at least some harm”., with unanimous decisions by the jury.
There is a high legal bar for this to occur, however, because there is no ability in English law to appeal against a not-guilty verdict. Once someone has been acquitted of an offence, they can only be tried again for the same crime if “substantial new and compelling evidence” is uncovered.
