A police officer who called a tasered man a "c***" and a "skanky "f***er" as he lay on the floor has been cleared of using excessive force against him.
They have both previously been cleared of criminal charges of attempting to pervert the course of justice at a crown court trial but six years on from the incident, a separate internal investigation against the pair is continuing. Mr Kelly, who was acting as a sergeant at the time of the incident, has been granted ill health retirement during the course of the much drawn out misconduct hearing while PC McLachlan has effectively been suspended for a long period of time.
After a period of deliberation Paul Forster, chair of the misconduct panel, agreed that insufficient evidence had been provided in relation to the excessive force charge against PC Kelly and that it would no longer proceed. The other charges will still be considered by the panel, however.
