Stuart Rodger has not received the £22,000 that would have been awarded to him - as a victim of the crime - because of a previous public order offence committed against the former prime minister.

compensation in 2018, politicians including Ruth Davidson, the former Scottish Conservatives leader, and Lord Falconer, the former Lord Chancellor and Shadow Justice Secretary, lobbied CICA on Rodger’s behalf, with letters of support. They argued that, among other issues, Rodger was on anti-depressants at the time of his public order offence which changed his normal behaviour, making him more disinhibited.

“I have therefore concluded that any difference in treatment on the ground of residence is justified,” he wrote, adding that ultimately this is a matter for politicians. “Whether and to what extent the state should pay compensation to victims of crimes who have themselves offended is a question of political judgment in relation to the allocation of scarce resources.”

The ruling against Rodger came just weeks before the Government opened its consultation on the compensation process after being ordered to review the unspent convictions rule by a High Court judgment last year. In that case a victim of child sexual abuse was also denied compensation due to a previous public order offence. The consultation closed in early August.
