If police see your dog in public, they can seize it. It will be up to you to prove it is not dangerous. You could face a fine and prison for owning it
Prime Minister Rishi Sunak has announced that American XL bully dogs will be banned by the end of the year following a series of attacks. It comes on the day a man died after an attack by two XL Bullies - the latest in a series of serious attacks in recent months.
Dog attacks have risen by more than a third over the past five years, and of the 10 fatal dog attacks in the UK last year, more than half of them have involved the American XL Bully. Most recently, a suspected XL Bully savaged an 11-year-old girl and two men on a busy shopping street in Birmingham over the weekend.
If your dog is in a private place they will need to get a warrant to seize it, but if they enter your property with a warrant for something else and find the dog they can seize it then. If your dog is a banned breed but the court does not believe it to be a danger to the public, it may be put on the Index of Exempt Dogs, which will allow you to keep it. In this circumstance, you'll be given a Certificate of Exemption that is valid for the life of the dog - but you'll need to follow strict rules.
